Is CBD oil legal in Ohio?

Yes, however what kind of CBD oil you are legally allowed to buy and use depends on the products THC content. For those without a medical cannabis license, its legal to buy and use CBD products containing less than 0.3% THC.

People that are legally eligible to use medicinal cannabis (i.e. they have a qualifying medical condition and a recommendation from a state physician) are able to purchase full-spectrum CBD (which contains both CBD and THC) and other CBD products with a higher THC content.

A wide range of CBD products are legal, including tinctures, capsules, edible form for oral administration, oils for vaporizers, topical creams and lotions, and hemp buds for vaping devices. The only form of administration that is illegal is using vaporizers that are “heated to temperatures at which medical marijuana plant material will burn” – which would eliminate its beneficial properties anyway.

Medicinal marijuana in Ohio

The law allowing medicinal marijuana to become legal in Ohio was only passed in late 2016, and the full law will not be entirely operational until September 2018 – when the laws that allow medicinal cannabis dispensaries to open will take effect.

Having said that, there are already provisions in place for patients with doctor’s notes from state physicians that allow them to smoke marijuana for treatment in the meantime. This also means that such patients can legally buy CBD products that have a higher tetrahydrocannabinol (THC) content.

Patients with the following medical conditions may qualify for medicinal cannabis treatment:

  • Human immunodeficiency virus infection and acquired immune deficiency syndrome (HIV/AIDS)
  • Amyotrophic lateral sclerosis
  • Alzheimer’s disease
  • Cancer
  • Chronic traumatic encephalopathy
  • Crohn’s disease
  • Epilepsy or another seizure disorder
  • Fibromyalgia
  • Glaucoma
  • Hepatitis C
  • Inflammatory bowel disease
  • Multiple sclerosis
  • ain that is either chronic and severe or intractable
  • Parkinson’s disease
  • Post-traumatic stress disorder
  • Sickle cell anemia
  • Spinal cord disease or injury
  • Tourette’s syndrome

Registered caregivers and patients are not allowed to have more than a 90-day supply.
